CCC is committed to complying with our obligations under the law. As part of this commitment we undertake to liaise with the Australian Competition and Consumer Commission to ensure complaints made and issues arising are dealt with expeditiously and with the full co-operation of our company. We provide a liaison officer who is responsible for providing information to, and being the first point of contact for, the Commission regarding this Commitment.
During induction and scheduled staff training sessions, all aspects of relevant Federal, State and Territory laws, regulations and codes of practice, that apply to the conduct of a commercial agency, are covered.
CCC strictly complies with these, including ACCC (the ACCC administers the Trade Practices Act 1974) guidelines, Australian Securities and Investments Commission Act (administered by ASIC) the Consumer Credit Code & Amendments, the Debt Collection Guideline: for collectors and creditors (jointly issued by ACCC and ASIC, 14 October 2005 and it reflects the ACCC’s and ASIC’s view of how relevant provisions of the Trade Practices Act and the ASIC Act apply to debt collection conduct. It covers the significant changes since 1999 to industry practices, case law, jurisdictional changes and the level and substance of complaints made to the ACCC and ASIC.), the relevant sections of the Australian Communications Industry Code of Credit Management & the Debt Collection Compliance Guide (based on Compliance Programs AS3806-1998 ).
Furthermore, the company complies with guidelines issued pursuant to the relevant Private Agents Act, Fair Trading Act, Property Agents and Motor Dealers Act 2000 and Commercial Agents Acts and ( but not limited to the) The Privacy Act 1998, Collections Act 1996 & Regulation, Commercial & Consumer Tribunal Act 2003, Complaints Handling AS 4269-995 and National Privacy Principals (see Privacy Policy) - this policy outlines the handling procedures of personal information by Commercial Credit Control Pty Ltd as set out in accordance with the National Privacy Principles in the Privacy Amendment (Private Sector) Act 2000.
